Lawyers: Brothers Convicted in Connection With Evergreen Cemetery Shooting Likely to be Deported

Two of Three Siblings from Florham Park have pleaded guilty.

After two of three brothers from Florham Park arrested in connection with an April shooting at Evergreen Cemetery pleaded guilty to rioting on Aug. 31, the lawyer one of the brothers has said the two are likely going to be deported back to their home country of Nicaragua.

Brian Kenney, the lawyer representing Oscar Guevara, 20, said Immigration and Customs Enforcement (ICE) had already been detaining the brothers and "any guilty plea will affect status," he said. "Likely, they will get deported."

Oscar Guevara, along with his brother Renan, 18, plead guilty in Superior Court in Morristown to fourth-degree rioting. The two each face sentencing of up to 270 days in jail.

Oscar and Renan admitted to knowing their stepbrother, Roberto Miranda, 20, also of Florham Park, had a gun when they went with him and two others to Evergreen Cemetery to fight another group on April 12.

Kenney said, "they didn't want part of it, as far as the gun was concerned."

"They admitted to the riot, they knew this guy had a gun," he said.

Although the guilty plea calls for 270 days in jail for each brother, Kenney said he believed the two would receive a "time served" sentence.
