Zoning Board Sued by Company Looking to Build Day Care Facility
Rainbow Academy application was denied in February for a rezoning request on Turtle Road.
Turtle Road LLC has filed suit in state Superior Court alleging the Morristown Zoning Board of Adjustment violated its constitutional and due process rights when it rejected an application to build a Rainbow Academy day care facility earlier this year.
According to dailyrecord.com, the Short Hills-based owner of the land – 1.439 acres near the Morris Township border – also claimed fliers were handed out to residents for “talking points” to use against the applicant.
